1. Overview
HappyMod respects the intellectual property rights of creators, developers, publishers, and copyright owners. We are committed to responding appropriately to valid copyright concerns and maintaining a platform that does not knowingly host or promote content that infringes the rights of others.
This Copyright Policy explains:
- How HappyMod treats copyrighted content
- What types of content are not allowed
- How copyright holders may report alleged infringement
- How users may respond to copyright claims
- What actions HappyMod may take when copyright violations occur
By using HappyMod, users agree to follow this Copyright Policy and all applicable intellectual property laws.
2. Respect for Intellectual Property Rights
Copyright protects original works of authorship, including but not limited to:
- Software and applications
- Source code and executable files
- Graphics, icons, screenshots, and visual assets
- Text, descriptions, guides, and documentation
- Audio, video, music, and sound effects
- Trademarks, logos, and branding elements when used in copyrighted materials
HappyMod does not claim ownership of third-party content, applications, brands, software, or copyrighted works unless expressly stated. All rights remain with their respective owners.
We expect all users, contributors, uploaders, and community members to respect the rights of copyright holders and to upload, share, or submit only content they have the legal right to use, distribute, or modify.
3. Content Policy
HappyMod may allow users or contributors to submit, discuss, review, or share information related to mobile applications, games, modifications, utilities, and related content. All submitted content must comply with this policy.
Prohibited Content
Users are not permitted to upload, submit, promote, or distribute content that:
- Infringes any copyright, trademark, patent, trade secret, or other intellectual property right
- Contains software, files, or assets copied from another party without authorization
- Circumvents copyright protection, license verification, digital rights management, payment systems, or access controls
- Distributes paid applications, premium features, subscriptions, in-app purchases, or paid content without authorization
- Includes copyrighted artwork, music, video, code, text, or other assets without permission
- Misrepresents ownership, authorship, or affiliation with an original developer or publisher
- Uses another company’s name, logo, or branding in a way that may confuse users
- Encourages piracy, illegal copying, unauthorized modification, or unauthorized redistribution
- Contains malware, spyware, malicious code, harmful scripts, or deceptive functionality
- Violates applicable laws or platform rules
User Responsibility
Users are responsible for ensuring that any content they submit or upload is lawful and does not violate the rights of others.
By submitting content to HappyMod, users represent and warrant that:
- They own the content or have permission to submit it
- Their submission does not infringe third-party rights
- Their submission does not contain unauthorized copyrighted material
- They have the necessary rights to grant HappyMod permission to display, process, store, review, or distribute the submitted content as required for platform operation
HappyMod may remove or restrict content at any time if we believe it violates this Copyright Policy, our content standards, applicable law, or the rights of another party.
4. No Endorsement of Unauthorized Content
HappyMod does not endorse copyright infringement, piracy, unauthorized copying, or unlawful distribution of software or digital content.
References to third-party names, applications, games, companies, or brands are for identification and informational purposes only. Such references do not imply endorsement, sponsorship, partnership, authorization, or affiliation unless expressly stated.
If copyrighted material appears on HappyMod without proper authorization, copyright holders are encouraged to submit a valid copyright notice as described in this policy.
5. Copyright Notice Procedure
Copyright holders or their authorized representatives may request removal or restriction of allegedly infringing content by submitting a copyright notice through HappyMod’s designated copyright reporting process.
To help us review a copyright claim efficiently, the notice should include all of the following information:
-
Identification of the copyrighted work
- A clear description of the copyrighted work claimed to have been infringed.
- If multiple copyrighted works are involved, provide a representative list of those works.
-
Identification of the allegedly infringing content
- A clear description of the content that is claimed to infringe.
- Sufficient information for HappyMod to locate the content on the platform, such as the title, page name, file name, package name, version, category, or other identifying details.
-
Statement of ownership or authorization
- A statement confirming that the complaining party is the copyright owner or is authorized to act on behalf of the copyright owner.
-
Good faith statement
- A statement that the complaining party has a good faith belief that the disputed use of the material is not authorized by the copyright owner, its agent, or the law.
-
Accuracy statement
- A statement that the information in the notice is accurate and complete.
-
Signature
- A physical or electronic signature of the copyright owner or an authorized representative.
A complete and accurate notice helps us identify the material at issue and take appropriate action. Incomplete, unclear, misleading, or abusive notices may delay review or may not be processed.
6. Review of Copyright Notices
When HappyMod receives a copyright notice that contains the necessary information, we may take one or more of the following actions:
- Review the reported content
- Temporarily restrict access to the reported content
- Remove the reported content
- Disable downloads or visibility for the reported content
- Notify the user or contributor responsible for the content
- Request additional information where necessary
- Take action against accounts that repeatedly violate this policy
HappyMod may remove or restrict content without prior notice when we believe the content may infringe copyright or violate our policies.
Submitting a copyright notice does not guarantee removal. HappyMod may evaluate whether the claim is complete, valid, and applicable to the reported content.
7. Counter Notice Procedure
If a user believes their content was removed or restricted by mistake or misidentification, the user may submit a counter notice through HappyMod’s designated review process.
A counter notice should include:
-
Identification of the removed or restricted content
- A description of the content that was removed or restricted.
- Information sufficient to identify where the content appeared before removal.
-
Statement of good faith belief
- A statement that the user has a good faith belief that the content was removed or restricted as a result of mistake or misidentification.
-
Statement of rights
- An explanation of why the user believes they have the right to use, upload, share, or distribute the content.
-
Accuracy statement
- A statement that the information provided in the counter notice is accurate and complete.
-
Signature
- A physical or electronic signature of the user or authorized representative.
After receiving a valid counter notice, HappyMod may review the matter and determine whether the content should remain restricted or may be restored. Restoration is not guaranteed and may depend on applicable law, platform rules, the nature of the content, and the information provided by the parties.
8. Repeat Infringer Policy
HappyMod may suspend, restrict, or terminate accounts that repeatedly submit infringing content or repeatedly violate this Copyright Policy.
Actions may include:
- Removal of submitted content
- Loss of upload or contribution privileges
- Account restrictions
- Account suspension
- Permanent account termination
- Blocking future submissions from the same user or source
HappyMod may determine repeat infringement based on valid copyright complaints, user behavior, content history, prior removals, or other relevant factors.
9. Misuse of the Copyright Process
HappyMod does not tolerate abuse of the copyright reporting process.
Users and copyright claimants must not submit notices or counter notices that are knowingly false, misleading, fraudulent, or submitted in bad faith.
Examples of misuse include:
- Claiming ownership of content without proper rights
- Submitting copyright notices to remove lawful criticism, commentary, review, or fair use content
- Reporting content that is not actually copyrighted or not owned by the claimant
- Submitting false counter notices to restore infringing content
- Repeatedly submitting incomplete or abusive complaints
HappyMod may reject abusive notices, restrict accounts involved in abuse, or take other appropriate action.
10. Fair Use and Legitimate Use
Some uses of copyrighted material may be allowed under applicable laws, including fair use, fair dealing, or other legal exceptions. These may include certain uses for commentary, criticism, news reporting, education, research, interoperability, or other lawful purposes.
HappyMod does not make final legal determinations about fair use or ownership disputes. When a copyright issue is unclear, the parties should resolve the matter directly through appropriate legal channels.
HappyMod may still remove or restrict content if we believe it violates our policies, creates legal risk, misleads users, or harms the platform community.
11. Modifications, Patches, and Derivative Works
Content involving modified applications, patches, add-ons, or derivative works must comply with copyright law and this policy.
Users must not submit or distribute content that:
- Includes copyrighted code, assets, or files without authorization
- Unlocks paid or restricted features without permission
- Bypasses licensing, subscription, authentication, or payment mechanisms
- Redistributes full applications or games in violation of the original owner’s rights
- Uses official assets in a misleading or unauthorized way
- Creates confusion about whether the content is official or endorsed by the original developer
Where modifications are discussed or shared, users must ensure they have the legal right to distribute the relevant materials.
12. Trademarks and Brand Materials
Although this policy focuses on copyright, HappyMod also respects trademarks and brand rights.
Users must not use names, logos, icons, screenshots, branding, or other identifying materials in a way that:
- Misleads users about the source of content
- Suggests false endorsement or affiliation
- Impersonates an official developer, publisher, company, or product
- Damages the reputation of another party
- Violates applicable trademark or unfair competition laws
HappyMod may remove or restrict content that misuses trademarks or branding, even where no copyright claim has been submitted.
13. Content Removal and Platform Discretion
HappyMod reserves the right to remove, restrict, disable, or refuse any content at its discretion, including content that:
- Appears to infringe intellectual property rights
- Violates this Copyright Policy
- Violates applicable law
- Creates security, privacy, legal, or reputational risk
- Is misleading, harmful, deceptive, or unsafe
- Is the subject of a credible complaint by a rights holder
Removal or restriction of content does not necessarily mean that HappyMod has made a final legal determination regarding infringement.
14. User Notifications
When appropriate, HappyMod may notify users if their content has been removed or restricted because of a copyright complaint or policy violation.
A notification may include:
- Identification of the removed or restricted content
- A general explanation of the reason for removal
- Information about whether a counter notice may be submitted
- Any account restrictions or further actions taken
HappyMod may choose not to provide notice where doing so would be unlawful, impractical, harmful to security, harmful to the platform, or inconsistent with enforcement needs.
15. Legal Compliance
HappyMod aims to comply with applicable copyright laws and intellectual property regulations. Because copyright rules may vary by jurisdiction, users and copyright holders are responsible for understanding their own rights and obligations under applicable law.
Nothing in this Copyright Policy should be interpreted as legal advice. Users and rights holders should seek independent legal advice if they are unsure about their rights.
16. Changes to This Copyright Policy
HappyMod may update this Copyright Policy from time to time to reflect changes in law, platform operations, enforcement practices, or content standards.
Updated versions become effective when published. Continued use of HappyMod after changes are published means users accept the updated policy.
